Quote:

- The argument could be made that TNA has the legal right to sue WWE since they are using a contracted TNA performer to draw ticket sales and DVD sales for the 2012 WWE Hall of Fame with Ric Flair being inducted with The Four Horsemen.

No word yet if TNA will pursue any kind of action against WWE but as of earlier this week, they had not made any decision. It's possible TNA could work out a deal where WWE would pay them a settlement for their usage of Flair. [/quote]

Put it this way...

If TNA did this shit, WWE would have put them out of business. The problem is TNA does not hold the rights to the "Four Horsemen" copyright, hence why WWE will get away with this. WWE own all WcW tapes and the property rights. Ric Flair is part of the package and he fully well knows this. Its another small pay day for him and a another win for the WWE..

This is why TNA will never be able to compete with WWE! Vince is too smart.

I remember a few years ago, (I think it was December 2004), WWE had the brilliant idea to film a Royal Rumble trailer in Universal Studios. It wasn't enough that they INTENTIONALLY chose the location in which TNA Wrestling taped their shows, but they also DELIBERATLY chose a day in which they knew TNA was planning to tape. TNA were forced to reschedule their show.

Either way, they sent a bunch of TNA performers, mainly former WWE talent, along to the WWE promo shoot to show good will. But when WWE staff realised that TNA performers were there, they rushed their talent into the studio and locked the TNA stars out. Less than 24 hours later, TNA received a "Cease and Desist" order from WWE lawyers. The lawyers also demanded that TNA hand over ALL footage they filmed on that day (not just the parts that may have featured WWE talent). AND they ordered TNA to sign a contract that agreed that the footage was WWE legal property.

I don't know how it turned out. But WWE insisted that if TNA aired the footage on TV, kept a copy of the footage, or failed to respond within 21 days, they would be sued.

So TNA aired the footage on a pay-per-view instead! (with faces and voices edited out).
